From the supplier: A US District Court in Louisiana ruled that an estate tax return filing extension does not extend the time period for making a qualified disclaimer of a bequest. For a disclaimer to be qualified under Internal Revenue Code section 2518, the disclaimer must be irrevocable, it must be executed in writing, the disclaimant must not receive the property or any accompanying benefit, the interest must pass directly to another party, and the disclaimer must be delivered to the transferor in time. The disclaimer must be made within nine months of when the interest is created or within nine months of the disclaimant's 21st birthday.
